1. Agreement to Terms

By accessing or using Badge My Auto ("we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or purchase our products.

2. Products & Orders

All products are sold as novelty/decorative items. We reserve the right to refuse or cancel any order at our discretion. Prices are subject to change without notice. Colors and finishes may vary slightly from images shown online.

3. Shipping & Delivery

We ship worldwide. Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control. Risk of loss passes to you upon delivery to the carrier.

4. Returns & Refunds

Custom-made badges are non-refundable unless they arrive damaged or defective. Pre-made badges may be returned within 30 days of delivery in unused condition. Contact us at hello@badgemyauto.com to initiate a return.

5. Intellectual Property

All content on this site, including text, images, logos, and designs, is the property of Badge My Auto and protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written consent.

6. User Conduct

You agree not to submit custom badge text that is threatening, defamatory, obscene, or infringes on any third party's rights. We reserve the right to refuse any custom order at our discretion.

6a. Prohibited Content and Design Ownership

Badge My Auto only produces custom badges from designs, text, images, and artwork that the customer legally owns or has the right to reproduce. By placing an order, and by checking the design-ownership confirmation on the configurator, you represent and warrant that:

• You own, created, or have written permission to use the design, text, photo, logo, or artwork you are submitting.
• Your design does not incorporate any third-party trademarks, service marks, brand names, team names, team logos, team colors used as a team mark, character likenesses, celebrity names or faces, or other copyrighted or trademarked content that you are not licensed to use.
• Your design does not include university names or Greek-letter organization marks unless you hold a valid license from the applicable institution or organization.
• Your design does not include vehicle manufacturers' badges, emblems, or trade dress that you do not own.

We reserve the right, in our sole discretion, to refuse, cancel, or refund any order that we believe may infringe on a third party's intellectual property, publicity, or other rights, even after the order has been placed or partially produced. You agree to defend, indemnify, and hold Badge My Auto harmless from any claims, damages, or costs (including reasonable attorneys' fees) arising out of or related to designs you submit, including any third-party claim of infringement.

If you'd like something inspired by a brand, team, or character but produced legally, we can almost always make a version that captures the look, your name in the same colors, a number, or an original custom design. Contact us at hello@badgemyauto.com before ordering if you're unsure whether your design is permitted.

7. Limitation of Liability

Badge My Auto shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products, including but not limited to damage to vehicles during installation or removal.

8. Changes to Terms

We may update these Terms at any time. Continued use of the site after changes constitutes acceptance of the new Terms.
